SALES TERMS AND CONDITIONS
1. Conditions
The business relationship between FiveCo Sàrl (hereinafter FiveCo) and the buyer shall be governed exclusively by these general terms and conditions of sale. These conditions take precedence over all other conditions.
2. Delivery
The products listed in our catalogs are usually delivered without delay ex warehouse. If an ex-warehouse shipment is not possible, the expected delivery date will be indicated in the order confirmation. In any case, we cannot be held responsible for any delays in delivery.
3. Technical data
All technical information is given in the user manuals and is considered to be the only valid information. The latest version of the user manual takes precedence over all previous versions.
4. Prices
All prices are quoted in Swiss francs. VAT is not included. All prices are indicative and apply during the period of validity of the catalog, price lists or offer, except in the case of clerical, printing or calculation errors. In addition, we reserve the right to make reasonable price increases in the event that a price increase occurs after the publication of the relevant catalogs.
Postage and packing will be charged separately.
5. Payment
All our prices are calculated net. Our invoices must therefore be paid without any deductions and at the latest 30 days after the date of invoice. In the event of non-compliance with this payment deadline, we are entitled to charge interest on arrears of 7% as well as administration costs. We reserve the right to execute orders from new or existing customers against cash on delivery or advance payment.
6. Complaints
If the delivery does not correspond to the order, the purchaser may submit a written complaint to this effect. Such a complaint must be notified to us within 5 days of the delivery date, otherwise the delivery is deemed to have been accepted.
7. Returns
Items listed in the catalogs may be returned within 14 days of the invoice date under the following cumulative conditions:
– All returned materials must be in new condition and in the original packaging.
– All items must be complete and capable of functioning.
– When items are packaged in a case, the case must not have been opened under any circumstances.
Failure to comply with any of these conditions will result in refusal of the return and no refund will be issued.
8. Guarantee
The products benefit from a two-year warranty from the date of issue of the invoice.
In the event of a warranty claim, the defective material must be returned to us with a copy of the invoice. The guarantee is excluded if the malfunction is the result of an intervention by the buyer, if it is the result of normal wear and tear, negligence or lack of maintenance by the buyer, or if the malfunction is the result of a situation of force majeure, or if the box has been opened.
In any case, our warranty is limited to the replacement of the defective equipment, excluding any compensation.
9. Responsibility
The purchaser is responsible for the selection and use of the products as well as the combination with other products. He is also responsible for the implementation of all useful safety measures. Furthermore, he/she must take all necessary care and follow all instructions of FiveCo and the supplier.
We are not liable for any damage resulting from the installation or use of the purchased products.
10. Applicable law and place of jurisdiction
The relationship between FiveCo and the buyer is governed by Swiss law. The place of jurisdiction is Lausanne.
